Some clarification and additional information:

To clarify:
  1. Although there were reports that 7-year-old Nixzmary was sexually assaulted, no one was ever charged with sexual assault; therefore, I must pass along that I have not been able to verify that she was sexually assaulted, by her stepfather or by anyone else.

  2. Indications are that Nixzmary was being physically abused and neglected over the course of time (at the time of her death she weighed 36 pounds, even though there was ample food in the refrigerator to feed her). Reports of suspected abuse were lodged by a school counsellor after bruises were found on Nixzmary. She also noted that the girl had missed 46 days of school. Pleas from a school social worker to Administration For Children's Services (ACS) in New York to have the girl removed from the home were ignored, and she was denied access to the home by the girl's stepfather.

  3. Although Nixzmary was neglected and starved, she did not die of starvation; she was beaten to death.
Additional information:
  1. The stepfather, Cesar Rodriguez, was convicted. Brooklyn Supreme Court Justice L. Priscilla Hall issued a maximum sentence to Cesar Rodriguez: 25 years for first-degree manslaughter and up to 4 years for false imprisonment. His prison term will be from 26 1/3 to 29 years.

  2. The mother, Nixzaliz Santiago, was also convicted of manslaughter, and received the same sentence that Rodriguez received. She was sentenced to more time because of previous convictions: assault for binding her daughter Nixzmary with a bungee cord, blackening her eye, unlawful imprisonment and endangering her welfare. After issuing scathing remarks to Santiago, Justice Patricia DiMango sentenced the girl's mother to 43 years in prison.

  3. In January 2006, shortly after Nixzmary's death, "Nixzmary's Law" was proposed by New York State senator Joseph Bruno. The Bill was passed into law. Parents who are connected to the crime of the death of their children will be charged with first degree murder, which carries a maximum sentence of 25 years to life in prison without the possibility of parole.

one more innocent child gone ever so cruelly from this world .

We hope, but sadly there will be another similiar case in somewhere near us in the world around us. There's always the percent who will never learn from a death like Nixzmary Brown. Thanks for giving us the facts Darlene most important but makes very little difference to Nixzmary. Is life in a Prison ever going to bring reasoning to these people. A dead child at their hands of cruelty. Step parents in a high percent never fill the Gap. They are different flesh and blood. They bring their own agenda to a second relationship. That is why there will be another Nixzmary. I have another innocent child with the God I believe in An Angel. It is some consolation for me to know God looks after His Family. My prayer is that the cruel death of Nixzmary will move hearts of stone from the sort of people who do such things and give them hearts of flesh and of love for the innocent child.

stop cruelty to children

i have read about 7 year old nixzmary and it is really upsetting to think y an adult could do such horrible things to a child like her stepfather did y didnt anyone do anything about it befour she died i hope he rots in hell because a child should not be tret in such evil way i am 17 year old and i was tret badly by my mums ex boyfriend when i was a child and i realise now that it is wrong for a child to be hurt like that a child is a gift from god to us keep them safe and love them as much as they love you let them see happyness dont let anymore children suffer plases help them they need our help.

god this child was beautiful.
she is no longer in pain and doesnt have to suffer the cruel man inflicted by that jerk off stepfather and b**** mother.

Child abuses are increasing in our world day by day and the organization and the government authorities are closing their eyes and keeping their mouth shut. Some small children are undergoing rape. And some are even worst cases I don’t know where this world is going.
