I'm so sorry that you and your children are facing this. I don't know the laws where you are and I don't know that the lawyer who advised you is correct. Perhaps there is someone who visits this site that can give you some helpful information. All I can offer here are words of encouragement. Consider contacting your local congressional representative to get the information out about this "loophole". It may not be enough or fast enough to protect your children, but perhaps it can bring about change for others in a similar situation. Thank you for sharing your story about the system with my visitors and me. I send you and your children love, light and healing energy.

Child abuse protocol

If a child is currently being neglected in California (L.A.) it matters not where the perpetrator lives. The case involves ONLY the children's whereabouts. the same is true for children across the U.S.A.

If you have called C.P.S. in California, and that is where the children are (currently) they are obligated to consider the case. They do not have to act if their investigation turns up nothing which they consider "jeopardy" the universal standard for child endangerment.

IF you want to embarrass the State into action, I would suggest a letter to the Los Angeles County sheriff's Department and the Los Angles Times newspaper.

Neglect reports are not easy to substantiate. The authorities have to show up when the neglect is occurring (unlike abuse which leaves bruises) if the complaint is that the care giver leaves the children alone, then the authorities have to arrive when he is not there. If the complaint is that there is no food in the house they must be there when there is actually no food.

This requires that you not call only once. you need to call every day that you know neglect is happening. You need to nag them into action.
